1. INTRODUCTION

At TechJutsu Inc. (“TechJutsu”, “we”, “us”, or “our”) we take the privacy of our users very seriously. This Privacy Policy describes our policies and practices regarding our collection, use, and disclosure of information that applies to your access and use of the websites located at www.techjutsu.com and www.callerverify.com (the “Site”) and the Services (as defined below), on behalf of yourself or your organization. The Site includes, but is not limited to www.techjutsu.com and www.callerverify.com and all other sites owned and operated by TechJutsu that redirect to the Site, all subdomains provided through such other site or the Site, and all downloadable applications, features, functionality, content or information that is made available or provided on the Site or through the Services. The Site is made available to you for the purposes of providing you with access to order, gain additional information about, and use TechJutsu’s telephone caller identity verification services, and other related online services, products and information provided by TechJutsu from time to time (the “Services”). This Privacy Policy relates to all of our activities, unless we have provided you with a separate privacy policy for a particular product, service or activity.

Please read this policy carefully to understand our policies and practices for collecting, processing, and storing your information. If you do not agree with our policies and practices, you must not use the Site or the Services. By accessing or using our Sites or using the Services, you indicate that you understand, accept, and consent to the practices described in this policy.

We may change this Privacy Policy from time to time in our sole discretion, so please be sure to check back periodically. You can tell if this Privacy Policy has changed by checking the last updated date that appears at the beginning of this Privacy Policy. When changes are made to this Privacy Policy, they will become immediately effective when published in a revised privacy policy posted on our Site, unless otherwise noted.  We may also communicate the changes through our Services or by other means. You should not continue using the Site or the Services if you do not agree with the version of this Privacy Policy in effect at that time. By continuing to use the Site or the Services, you agree and accept the version of this Privacy Policy in effect at that time. Any changes will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.

2. MEANING OF PERSONAL INFORMATION

Personal Information” means information about an identifiable individual.  This information may include, but is not limited to, your name, mailing address, e-mail address, telephone number, browsing information and country of residence.

Personal Information does not include information where there is no serious possibility that it can be used to identify an individual, whether on its own or in combination with other information, or Personal Information that has been anonymized or aggregated such as to be considered anonymized information or no longer Personal Information under applicable laws. For clarity, anonymized and aggregated information that does not identify an individual is not subject to the obligations under this Privacy Policy.

3. YOUR CONSENT TO COLLECTION, USE AND DISCLOSURE

The primary basis on which we collect, use and disclose your Personal Information is with your consent, unless otherwise permitted or required by law.  Typically, we will seek your consent at the time your Personal Information is collected. Subject to applicable laws, your consent may be express or implied, depending on the circumstances and the sensitivity of the Personal Information in question.  If you choose to provide Personal Information to us, we assume that you consent to the collection, use and disclosure of your Personal Information as outlined in this Privacy Policy.

You may withdraw your consent to our use or disclosure of your Personal Information at any time by contacting us at privacy@techjutsu.com. However, before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services.

If you provide Personal Information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect such information from you, and to use and disclose their information as described in this Privacy Policy.

4. Personal information we collect

TechJutsu collects Personal Information to operate effectively and to provide you with the best experience possible when using our Site and the Services. Your Personal Information may be collected directly, such as when you email TechJutsu. Your Personal Information may also be collected indirectly, such as when you provide Personal Information to a third party platform made available on the Site or while using our Services.

The types of Personal Information we may collect or obtain (depending on the circumstances) include but may not be limited to:

  • Information you provide us: We collect information you provide to us, including your name, email address, telephone number, age, location, postal address and any other identifier we may use to contact you. We also collect information you submit to us by filling in forms on our Site or in the course of using our Services. This includes, but is not limited to, information provided at the time of setting up an account on our Site, purchasing Services from us or in the course of using the Services.

  • Information you provide third parties to use our Services. Many of our Services are provided in conjunction with or through third parties. For example, our caller identity verification service is provided as an add-on to Okta Inc.’s (“Okta”) identity management enterprise platform. Okta collects Personal Information from you in accordance with its privacy policy, as listed in the “Third Party Platforms” section.

  • Notes and comments. Information about any specific requests made by yourself in respect of the Services or the Site.

  • Feedback Surveys. Information you provide to us through product feedback surveys or requests.

  • Transaction Information. Details of transactions you carry out through our Site and when you make purchases related to the Services. You may be required to provide financial information before placing an order through our Site or in the course of using the Services.

  • General usage data. When you use our Site, we may also collect your Internet Protocol (“IP”) address, information about the date and time of your access as well as how long you use our Site in each session, features you use in our Site, and how long you use our Site overall.

  • Cookies. In addition, when you visit our Site, we may collect certain information about your activity on our Site, as described below under the heading “Our Use of Cookies and Log Files”.

  • Other information. Other Personal Information you may choose to provide to TechJutsu when corresponding with us by email, over the phone or otherwise. We may also retain records and copies of such correspondence, including your contact information.

 

Third Party Platforms: Third-party platforms or websites used for the operation of the Site and Services may also collect, use, and disclose your Personal Information. While some of these third-party platforms may collect Personal Information on TechJutsu’s behalf or transmit Personal Information to TechJutsu as part of Service delivery, including the information set forth above, they may also collect additional Personal Information about you or the devices that you use to access the Site. We do not control these third party platforms or websites and note that such third parties also have their own privacy policies that govern how they collect, use and disclose your Personal Information. We encourage you to read these third party privacy policies, along with the privacy policies of any other third-party websites, plug-ins, services, social networks, or applications linked to or made accessible through our Site.

5. How we use your personal information

We use the Personal Information we collect from you to respond to your requests, communicate with you, to customize your use of our Site or Services, to provide you with, or facilitate your access to, the Services, and in any other way may describe to you at the time you provide your information to us. For example, we may use the information you provide us to fulfil an order you make for the Services, to execute the Services, to provide technical support in respect of the Services or to respond to any inquiries you may have about the Services. We may also use your Personal Information in other ways with your consent or as permitted by applicable law.

To the extent permitted by applicable law, we may use, process, transfer, and store any data about individuals and customers or partners in an aggregated manner. We may combine Personal Information with other information collected online and offline, including information from third party sources, in accordance with applicable privacy laws. We may share aggregated or anonymized data with third parties for advertising purposes, to our existing or prospective clients for business development purposes, or publicly. For example, we may share information publicly to show trends about the general use of our Services.

For Quebec Residents: We will obtain your explicit consent before using any personal or pseudonymized information for advertising purposes, including sharing such data with third parties for targeted marketing or business development. 

6. OPTING OUT OF COMMUNICATIONS

We may also use your information to contact you about certain TechJutsu products, activities, services or promotions that may be of interest to you, as permitted by law. If you no longer want to receive marketing-related emails from us, you may opt out of receiving marketing-related emails by contacting us directly at privacy@techjutsu.com.

We will endeavour to respond to your opt-out request promptly, but we ask that you please allow us a reasonable time to process your request.  Please note that if you opt out from receiving marketing-related emails, we may still need to send you communications about your use of our products or services, or other matters.

7. HOW WE DISCLOSE YOUR PERSONAL INFORMATION

We may disclose Personal Information that we collect, or you provide as described in this Privacy Policy:

  • With our affiliates or any business partners or agents acting on our behalf or with our financial, insurance, legal, accounting or other advisors that provide professional services to us.

  • To a company or individual employed or engaged by us to support our business or perform functions on our behalf, such as data processing, maintaining the Site or performing the Services. Any such disclosure of your Personal Information is made on a strictly confidential basis, and the information is to be used only for the purpose for which it was shared.

  • To a potential buyer, investor, new subsidiary or affiliate, or other successor in the event TechJutsu or any affiliate, portion, group or business unit thereof, undergoes a business transition, such as a merger, acquisition, consolidation, reorganization, divestiture, liquidation or dissolution (including bankruptcy), or a sale or other transfer of all or a portion of any assets of TechJutsu or any of its subsidiaries or affiliates or during steps in contemplation of such activities (e.g., negotiations and due diligence).

  • To third-party service providers we engage to carry out specific business functions on our behalf. These may include, but are not limited to: website hosting providers, data storage and cloud service providers, customer support and helpdesk service providers, IT security and cybersecurity service providers. Any such disclosure is made on a strictly confidential basis and solely for the purpose for which the information was shared. All service providers are contractually obligated to protect Personal Information and process it in compliance with applicable privacy laws.

  • To fulfill the purpose for which you provide the information. For example, if you contact us seeking technical support, we may disclose your contact information and the particulars of your request to TechJutsu personnel or a contracted technician.

  • For any other purpose disclosed by us when you provide the information.

 

We may also disclose your Personal Information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law.

  • To enforce or apply our Website Terms of Use, Master Services Agreement and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TechJutsu, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

8. YOUR RIGHTS REGARDING YOUR PERSONAL INFORMATION

Individuals have a number of rights concerning their Personal Information under global privacy laws. Under certain conditions, you may make a written request to access, correct or delete any Personal Information about you that we have collected, used or disclosed, and we will provide you with any such Personal Information to the extent required by law. You may also challenge the accuracy or completeness of your Personal Information in our records. If you successfully demonstrate that your Personal Information in our records is inaccurate or incomplete, we will amend the Personal Information as required. For any requests related to Personal Information collected, used or disclosed by a third party, please direct your request to the relevant third party, and not to TechJutsu. TechJutsu disclaims any liability or responsibility for third party content, tools and websites in other sections also.

 

Where applicable, you may be entitled to additional rights, including: (i) the right to withdraw consent to processing; (ii) the right to object to unlawful data processing, under certain conditions; (iii) the right to erasure of Personal Information about you, under certain conditions; (iv) the right to demand that we restrict processing of your Personal Information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, processing is no longer necessary, or believe your Personal Information is inaccurate; (v) the right to data portability of Personal Information concerning you that you provided us in a structured, commonly used, and machine-readable format, under certain conditions; (vi) the right to object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you, under certain conditions; and (vii) the right to de-indexing of your Personal Information.

 

Please note that such rights are not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal data that we hold about you. In the event that we cannot accommodate your request, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

 

You also have the right to lodge a complaint with the relevant data protection or privacy authority, such as the Office of the Privacy Commissioner.

 

We may require that you provide sufficient identification to fulfill your request to access or correct your Personal Information. Any such identifying information will be used only for this purpose. We will not charge you any fees to access your Personal Information in our records without first providing you with an estimate of the approximate fees, if any.

9. DATA SECURITY

We have implemented commercially reasonable physical, organizational, contractual and technological security measures with a view to protecting your Personal Information from accidental or unlawful destruction, loss or theft, unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that the only personnel who are granted access to your Personal Information are those with a business ‘need-to-know’ or whose duties reasonably require such information.

Despite the measures outlined above, no method of information transmission or information storage is 100% secure or error-free, so we unfortunately cannot guarantee absolute security. In the case of a breach of security safeguards, we will act promptly to mitigate the risks and to inform you where there is a real risk of significant harm, or as otherwise required by law.

Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

10. DATA RETENTION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. By using the Site and/or the Services, you agree that we are hereby licensed to collect, use, share, and store anonymized (or pseudonymized) aggregated data collected through the Site or the Services for benchmarking, analytics, metrics, research, reporting, machine learning, and other business purposes.

11. OUR USE OF COOKIES AND LOG FILES

We may use browser tracking cookies (or “cookies”), which are small text files that are placed on the hard disk of a computer by a website. Cookies are uniquely assigned to you and can only be read by a website or web server that issued the cookie to you.  We may also use browser “log files” which record certain information when you visit a website, including your IP address.

To improve your experience on our Site, we may use cookies and log files to: recognize you when you return to our Site; keep track of activity on our Site; remember what items you have clicked on or viewed; study how you navigate through our Site and which website you request in site searches so that we can improve the design, content and function of our Site; and customize the message, content and delivery of online banner advertisements and e-mails that reflect how you navigate to and through our Site based on your online behavior. We call this “Browsing Data”. We may engage third-party service providers to assist us in the collection and analysis of this Browsing Data collected through cookies, but none of your Personal Information is disclosed to these third party service providers.

12. YOUR CONSENT AND CONTROL OVER COOKIES

Where cookies are enabled, you have the ability to accept or decline our use of cookies. Most browsers allow you to manage cookie settings through their preferences menu. You can refuse cookies by turning them off or blocking them in your Internet browser. However, please note that disabling cookies may affect the functionality of certain features on our Site. If you decide to turn off or block cookies, our Site might not function correctly.

13. TRANSFERRING YOUR PERSONAL INFORMATION

Personal Information is primarily processed and stored in the United States and Canada. We may transfer Personal Information that we collect or that you provide, as described in this policy, to contractors, service providers, and other third parties we use to support our business. These third parties are contractually obligated to maintain the confidentiality of Personal Information, use it only for the purposes disclosed, and process it in accordance with the standards outlined in this policy.

Such third parties may process, store, and transfer your Personal Information outside of Canada, the United States or the province of Quebec. In such cases, your information may be subject to the laws of those foreign jurisdictions, and could be accessible to their governments, law enforcement, or regulatory authorities.

 

For Canadian residents in the Province of Quebec: In accordance with Quebec’s privacy legislation, we will identify the jurisdictions to which your Personal Information may be transferred. Where applicable, we will conduct a Privacy Impact Assessment (PIA) before transferring any Personal Information outside of Quebec, to ensure that such information receives adequate protection in accordance with applicable legal requirements.

14. PERSONAL INFORMATION USED BY THIRD PARTY WEBSITES

From time to time, we may include links to third party websites which are not controlled or maintained by us. We are not responsible for Personal Information submitted by you to third party websites or the Personal Information collected by third party websites. You should review the privacy policies of third party websites or contact the third party website's operator if you have questions or concerns.

15. “DO NOT TRACK” SIGNALS

We will not respond to web browser “do not track” signals. If you would like additional information about online tracking and various opt-out mechanisms, please see https://youradchoices.com/.

 

Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different websites when you visit this Site.

 

In addition, we use Google AdWords, so we are advertising the Site online through a form of tracking called remarketing. Third-party vendors, including Google, show our ads on various sites across the Internet, and use cookies to serve you ads based on your past visits to this Site. You can opt out of Google’s use of cookies by visiting Google’s Ads Settings

16. AGE OF MAJORITY

We recognize the importance of protecting the privacy and safety of children. The Site or Services are not intended for individuals under the age of majority in their jurisdiction. We do not knowingly collect Personal Information from minors. Anyone under the age of majority in their country of residence should not use the Site or the Services. If we learn we have collected or received Personal Information from a minor without verification of parental consent, we will delete such Personal Information.
